Khandelia, the learned counsel appearing on behalf of the Petitioner submitted that taking into account the scope of a claim proceedings under the Motor Vehicles Act, 1988, he would not like to press the instant petition. However, it has been submitted that he may be given the liberty to submit a fresh list of witnesses before the learned Tribunal. 2. The learned counsel appearing on behalf of the Respondents did not object to the same. 3. Taking into account the above, this Court closes the instant petition on withdrawal. 4. Liberty is given to the Petitioner to submit a fresh list of witnesses in MACT Case No.36/2021 pending before the Court of the learned Member, Motor Accidents Claims Tribunal, Dibrugarh. 5. Interim order passed on 22.02.2023 stands vacated and the parties who are duly represented before this Court are directed to appear before the learned Member, Motor Accident Claims Tribunal, Dibrugarh on 10.03.2025.
