HC-KAR NC: 2025:KHC:37437 WP No. 28444 of 2025
ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent Nos.2, 3 and 4 to hold and conduct election to the respondent No.5. He has also sought a writ in the nature of mandamus to direct the respondent No.4 to issue calendar of events forthwith by announcing the date of events of the election to the respondent No.5.
2. The petitioners are members of the respondent No.5. It is stated that the term of the Board of Management of respondent No.5 came to an end on 26.01.2025. In the meanwhile, notices under Rule 13D of the Karnataka Co- operative Societies Act, 1959, were sent on 30.10.2024 to all the ineligible voters. The list of eligible and ineligible voters is also finalized and a provisional list was published by the respondent No.5. A verification officer is also appointed to verify the voters list. Nonetheless, the petitioner contends, that the respondents have not taken any steps to notify the elections, though a returning officer is appointed. The petitioners therefore seek for a direction to the respondents to hold and conduct elections by issuing a calendar of events.
