CRM-M-65839-2025 1 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 138 CRM-M-65839-2025 (O&M) Date of decision: 15.07.2026 JASWINDER SINGH .... PETITIONER(S) VERSUS STATE OF PUNJAB ...RESPONDENT(S) CORAM: HON’BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Abhinav Singla, Advocate for the petitioner. Mr. Adeshwar S. Panny, AAG, Punjab. **** JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 528 of BNSS, 2023 is for quashing of the FIR No.10 dated 12.01.2022 (Annexure P-1) under Section 174-A IP, registered at Police Station, City II Mansa, District Mansa. 2. The learned counsel for the petitioner contends that the present FIR is an outcome of the order dated 24.12.2021 passed by the Additional Chief Judicial Magistrate, Mansa, vide which the petitioner was declared a proclaimed offender in FIR No.54 dated 01.04.2021 under Sections 420, 465, 467, 468, 471 and 120-B of IPC, Police Station City II Mansa, District Mansa. The said order stands quashed by a Co-ordinate Bench of this Court in CRM-M No.50310 of 2024 on 13.11.2024 (Annexure P-2), with the directions that the petitioner was to surrender within a period of 04 weeks. KUSUM 2026.07.16 16:32 I attest to the accuracy and integrity of this document PHHC Chandigarh CRM-M-65839-2025 2 Inadvertently, at that stage, the consequential FIR No.10 dated 12.01.2022 under Section 174-A IPC, Police Station City-II, Mansa, District Mansa, which is impugned in the present petition was not brought to the notice of the petitioner necessitating the filing of the instant second petition for quashing of the same. He contends that, in furtherance of the order dated 13.11.2024, the petitioner has surrendered before the Trial Court and has been granted the concession of bail. He is regularly appearing before the Trial Court and is facing trial. Therefore, the FIR be quashed. 3. The learned counsel for the State has not disputed the factual assertion that the petitioner has surrendered before the Trial Court in furtherance of the order dated 13.11.2024, and is now facing trial, but contends that he surrendered beyond a period of 04 weeks as directed. 4. I have heard learned counsels for the parties. 5. Admittedly, the petitioner challenged the order dated 24.12.2021 passed by the Additional Chief Judicial Magistrate, Mansa in FIR No.54 dated 01.04.2021 under Sections 420, 465, 467, 468, 471 and 120-B of IPC, whereby he had been declared a proclaimed offender. The said order was quashed. At that stage, the petitioner was unaware that consequent to the order dated 24.12.2021, an FIR No.10 dated 12.01.2022 had already been registered under Section 174-A IPC. Because of the said fact, quashing of the consequential FIR was not sought in the earlier petition bearing CRM-M No. 50310 of 2024. Upon the said fact being brought to the notice of the petitioner, the instant petition has been filed for the quashing of the said FIR. As the order dated 24.12.2021 whereby the petitioner was KUSUM 2026.07.16 16:32 I attest to the accuracy and integrity of this document PHHC Chandigarh CRM-M-65839-2025 3 declared a proclaimed offender already stands quashed, it would be an exercise in futility to keep alive the consequential FIR, particularly when the petitioner has surrendered before the Trial Court and is now facing trial. 6. In view of the above, FIR No.10 dated 12.01.2022 under Section 174-A IPC, Police Station City II Mansa, District Mansa, and all other consequential proceedings arising therefrom stand quashed. 7. All the pending miscellaneous applications, if any, stand disposed of.
