ORAL ORDER Petitioners are seeking to quash the FIR in Crime No.48/2025 registered at Sampigehalli Police Station, Bengaluru City, for the offence Punishable under Section 448, 406, 420 and 120B of IPC. 2. Petitioners are arraigned as accused Nos.1 and 3, respectively in the FIR. 3. An application is filed to permit the parties to compound the offence. The application is signed by the

petitioners and respondent No.2, and the learned counsel appearing for them. 4. Petitioners and respondent No.2 are present before the Court. They submit that they have amicably settled the dispute and respondent No.2 has agreed to pay a sum of Rs.6,00,000/- infavour of petitioner No.1, in turn, petitioners have agreed to vacate the schedule property. Further, the parties have agreed that no claims or disputes shall survive between them in respect of the subject matter. 5. Paragraph Nos.1 to 3 of the application are extracted hereunder:-

That the above named respondent no 2 has filed the complaint against the above named accused/petitioner's before the 1st respondent ie Sampigehalli Police, the FIR is registered in Crime no 48/2025 for the offence Punishable u/s 448, 406, 420 and 120B of IPC pending on the file of 41st ACJM Bangalore. - 4 -

2. That the above-named accused/petitioner's have filed the above criminal petition u/s 482 of CRPC to quash the entire investigation in Crime no. 48/2025 of Sampigehalli Police for the offence Punishable u/s 448, 406, 420 and 120B of IPC pending on the file of 41ST ACJM Bangalore. 3. That both parties have amicably settled their disputes, and the matter has been mutually compromised in the presence of well-wishers. As per the terms of the compromise, Respondent No.2 has agreed to pay a sum of Rs. 6,00,000/- (Rupees Six Lakhs only) by way of Demand Draft bearing No. 015981 dated 09.12.2025, drawn on IDBI Bank, Ashwath Nagar, Bengaluru Branch, in favour of Petitioner No.1. In return, the Petitioners have agreed to vacate the Schedule Property. Both parties further agree that no claims or disputes shall survive between them hereafter in respect of the present subject matter. 6. The dispute between the petitioners and respondent No.2 is private in nature.
The parties have come forward to settle the matter by filing an application. - 5 -

It is stated that the matter has been mutually compromised as per the terms in the application. 7. The Hon’ble Apex Court in Narinder Singh and Others V. State of Punjab and Another reported in (2014) 6 SCC 466 has held that when the parties have reached the settlement and on that basis, petition for quashing the criminal proceedings is filed, the guiding factor in such cases would be:(i) to secure the ends of justice; or (ii) to prevent abuse of the process of any Court. It is further held that the criminal cases having overwhelmingly and predominantly civil character, particularly those arising out of commercial transactions or arising out of matrimonial relationship or family disputes should be quashed when the parties have resolved their entire disputes among themselves. 8. In view of the settlement between the parties, no purpose will be served in keeping the proceedings pending against the petitioners. Hence, to secure the ends

of justice, it is just and proper to quash the proceedings. Accordingly, the following:-
ORDER i) Application is allowed, consequently, petition is allowed. ii) FIR in Crime No.48/2025 registered at Sampigehalli Police Station, Bengaluru City, is quashed, qua the petitioners.
