JUSTICE M.NAGAPRASANNA) The petitioner is before this Court calling in question the endorsement dated 02.01.2024 passed by the respondent declining to accept the representation of the petitioner for appointment on compassionate ground. 2. Heard Sri S.K. Hegde, learned counsel for petitioner. 3. The father of the petitioner was working as driver in NWKRTC, Belagavi. He dies in harness on 07.10.2005, within an year, the mother of the present petitioner submits a representation seeking appointment on compassionate ground. The said representation is not considered. The petitioner then after he attains the age of 18 years submits a second representation on 05.09.2023 seeking appointment on compassionate ground. The representation was not considered which led the petitioner to submit yet another representation. An endorsement - 3 - NC: 2025:KHC-D:17 WP No. 106452 of 2024 comes out on 02.01.2024 by which the claim of the petitioner comes to be rejected. 4. Learned counsel appearing for the petitioner would vehemently contend that the representation of the petitioner ought to have been considered in accordance with law as the petitioner has submitted his representation immediately on attaining the age of 18 years and thereafter submits that the endorsement should be quashed and mandamus should be issued to the respondent to appoint the petitioner on compassionate ground. 5. The said submission is noted only to be rejected. 6. Compassionate appointment is granted to a family who would lose their bread winner who died on the crisis that eschews the said family on the death of the bread winner. The death in the case had happened in the year 2005. We are now in 2025. 20 years thereafter no - 4 - NC: 2025:KHC-D:17 WP No. 106452 of 2024 mandamus can be issued for consideration even of the appointment on compassionate ground. On this score if the family was able to survive for 20 years without any appointment, the compassionate having gone long ago mandamus cannot follow.
