JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question entire proceedings in C.C.No.15479/2022, pending before the 8th Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 384 and 34 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that during the pendency of the proceedings before this Court, the parties to the lis have settled their dispute amicably by drawing up certain terms and conditions. The parties have filed an application under Sections 320(2) r/w. 482 of the Cr.P.C., along with a joint affidavit before this Court reporting such settlement. 3. The joint affidavit reads as follows: “We, 1) Sri. Manoj Kumar S/o Nanje Gowda Aged about 25 years, R/o No-202, sri Shaila inclive 3rd cross, - 3 - HC-KAR NC: 2025:KHC:28640 CRL.P No. 6148 of 2023 Domaluru Layout Bengaluru -560020 2, ri Arivinda, S, S S/o Shivanna, Aged about 50 years, R/at No-019, Kaveri Block National Games Village kormangala, 560034 are all are now at Bengaluru do hereby solemnly affirm and state on oath as follows; 1. The petitioner is accused persons and Respondent No.2 is the defacto Complainant 2. The 2nd respondent Arvinda initiated proceedings against the petitioner for the offences punishable under sections 384 r/w 34 IPC and the same is pending in C.C.No. 15479/2022 (in Crime No. 35/2022 (in crime No.35/2022 of High Ground police) now which is pending on the file of the VIII A,C,M,M Bengaluru 3. Both the parties submits that they have settled the matter in C.C.No15470/2022 with the advice of elders, friends and well wishers and decided to live peacefully and happily in the locality. In view of this settlement, we pray for quashing of the proceedings in C.C.No.15470/2022 on the file of the learned VIII A.C.M.M., Bengaluru in the interest of justice.” In the light of the fact that the parties have arrived at settlement, though the offence punishable under Section 384 of the IPC, which is cognizable, I deem it appropriate to accept the application, permit the parties to compound the offence and terminate the proceedings against the petitioner, as the allegations are not against the State. - 4 - HC-KAR NC: 2025:KHC:28640 CRL.P No. 6148 of 2023 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.15479/2022, pending before the 8th Additional Chief Metropolitan Magistrate, Bengaluru, stand quashed. Ordered accordingly.
