ORAL ORDER
Challenging order dated 27.10.2025 passed by LXIII Addl. City Civil and Sessions Judge, Bengaluru (CCH-64), in SC.no.228/2021, this revision petition is filed.
2. Sri Hashmath Pasha, learned Senior Counsel appearing for Sri Kariyappa, learned counsel for petitioner submitted that this revision petition was by accused no.1 challenging order passed by learned Sessions Judge rejecting application for discharge filed under Section 227 of Code of Criminal Procedure, 1978, ('CrPC' for short).
3. It was submitted, in course of submissions, learned Senior Counsel submitted, a question 'when victim was on treatment for COVID-19 prior to his death, he had survived for six days after incident and medical records showed bullet injury to be in healing process, whether framing of charges against accused under Section 302 of Indian Penal Code, 1860 ('IPC' for short) would be justified?', would arise for consideration and petitioner would be entitled to file application under Section

228 of CrPC and therefore, learned Senior Counsel submitted, reserving such liberty, revision petition may be disposed of.
4. In view of above submission, examination of validity of impugned order on merits would not be necessary.
Revision petition is accordingly disposed of reserving liberty to petitioner to file application invoking Section 228 of CrPC and if such application is filed, Sessions Court to consider same in accordance with law and pass appropriate orders thereon.
