Dutta, the learned counsel appearing on behalf of the Page No.# 3/3 petitioners submitted that taking into account the scope and ambit of instant proceedings, he would not like to press the instant petition. Rather, if any decision goes against him in the trial, he would be at liberty to take appropriate grounds of objection in terms with Section 105 of the Code of Civil Procedure, 1908. 2. Taking into account the above, the instant proceedings stands closed on withdrawal. 3. However, the withdrawal of the instant proceedings shall not prejudice the defendants in the suit being T.S. Case No. 06/2016 to raise any grounds of objection, if the suit is decided against the defendants. 4. The interim order dated 26.02.2024 by which the further proceedings of Title Suit No. 06/2016 pending before the Court of the learned Civil Judge (Junior Division) No. 1, Golaghat (hereinafter referred to as, “the learned Trial Court”) was stayed is hereby vacated and the parties herein are directed to appear before the learned Trial Court on 11.03.2025.
