JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.3 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.568/2025 of Ramamruthy Nagar Police Station, registered for offences punishable under Sections 20(a), 20(b), 22(b) and 22(c) of Narcotic Drugs and Psychotropic Substances Act. 2. Heard learned counsel for petitioner and learned High Court Government Pleader for respondent - State. 3. Learned counsel for petitioner would contend that, the name of this petitioner has been arrayed as accused only on the statement of accused Nos.1 and 2. - 3 - HC-KAR NC: 2025:KHC:52230 CRL.P No. 14948 of 2025 There is no allegation of possession of any contraband by this petitioner. The allegation against the petitioner is supply of Narcotic Drug to accused Nos.1 and 2. The petitioner is a lady and she is a resident of Bengaluru and working in a private company. The petitioner is ready to co-operate with the Police in the investigation and abide by any conditions to be imposed by this Court. With these, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader for respondent would contend that, the petitioner is absconding since the date of registration of the case. The petitioner is alleged to have supplied the contraband to accused Nos.1 and 2. Accused Nos.1 and 2 have possessed the contraband of commercial quantity. The petitioner is required for interrogation. With these, he prayed for dismissal of the petition. - 4 - HC-KAR NC: 2025:KHC:52230 CRL.P No. 14948 of 2025 5. Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint and other materials placed on record. 6. Accused Nos.1 and 2 have been granted bail by the Special Court in Criminal Miscellaneous No.9185/2025 by order dated 03.11.2025. Accused Nos.1 and 2 were found possessed the contraband of commercial quantity. The petitioner's name has been disclosed by accused Nos.1 and 2 for having purchased the contraband from the petitioner/accused No.3. There is no allegation of possession of any contraband by this petitioner. The petitioner is a lady and she is ready to co-operate with the Investigating Officer in investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. 7. Considering all the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following; - 5 - HC-KAR NC: 2025:KHC:52230 CRL.P No. 14948 of 2025 ORDER The Criminal Petition is allowed. The petitioner is granted anticipatory bail in Crime No.568/2025 of Ramamruthy Nagar Police Station and is ordered to be released on bail in the event her arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the Investigating Officer. ii) The petitioner shall voluntarily appear before the Investigating Officer within 10 days from this day and execute bail bond and furnish surety. iii) The petitioner shall cooperate with the Investigating Officer in investigation. iv) The petitioner shall appear before the Investigating Officer whenever called for. - 6 - HC-KAR NC: 2025:KHC:52230 CRL.P No. 14948 of 2025 v) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer of tamper with the evidence. vi) The petitioner shall appear before the jurisdictional Police Station on every Sunday between 10.00 am to 2.00 p.m. for a period of two months or till the filing of the final report, whichever is earlier.
