VINOD S. BHARDWAJ, J. (Oral)
Prayer in the present petition is for directing the respondent- Appellate Authority i.e. the Dy. Inspector General Station Head Quarter Ladakh ITBP to decide the pending appeal of the petitioner.
Learned counsel for the respondents submits that this Court would not have the territorial jurisdiction since the Appellate Authority is situated in territorial jurisdiction of the High Court for the States of Jammu & Kashmir and Union Territory, Ladakh. He further submits that even the petitioner is a resident of Bihar. Counsel for the petitioner states that the Head Office of the Northern Western Frontier Province of ITBP is situated in Chandigarh, however, he is not in a position to controvert that the appeal is not to be adjudicated by the Head Office and instead by a Designated Appellate Authority which undisputedly is not situated within the territorial jurisdiction of this Court. The present petition is dismissed with liberty to approach the Competent Court having territorial jurisdiction into the matter.
