Mr. Saurabh Yadav, learned advocate appears on behalf of petitioner and submits, his client was running a pathology centre in part of the premises, taken on rent. Pursuant to complaint lodged against private respondent no.6 (son of the landlord), the authorities sealed another part of the premises, in which respondent no.6 was carrying on sex determination racket. Respondent no.5 (the landlord) has wrongfully denied access to petitioner's equipment, purportedly relying on aforesaid action of the authorities. His client made representation dated 29th March, 2025 to respondent no.2 (the District Magistrate). He seeks interference and direction for release of his client's equipment. Dr. G.C. Tiwari, learned advocate, Standing Counsel appears on behalf of State and submits, matter was referred to Chief Judicial Magistrate by the landlord and tenant. The writ Court should not interfere. Considering petitioner has made representation dated 29th March, 2025 on allegations which raised questions of fact, we direct respondent no.2 to deal with it and pass appropriate order. Petitioner will communicate certified copy of this order along with copy of his representation, to said respondent. Petitioner be informed on the consideration, within four weeks thereafter.
