BEFORE HONOURABLE MR. JUSTICE ROBIN PHUKAN ORDER Date : 17.03.2025 Heard Mr. A.A.R. Karim, learned counsel for the accused and Mr. K. K. Das, learned Additional Public Prosecutor, Assam, appearing for the State respondent.
2. This application under Section 483 of the BNSS, 2023, is preferred by accused, Sri Ayub Ali, who has been languishing in jail hazot, in connection with
Page No.# 2/2 Chapar P.S. Case No. 199/2024, under Section 25 (1-A) of Arms Act, 1959, corresponding to G.R. Case No. 562/2024, for grant of bail.
3. It is to be noted here that, above noted case has been registered on the basis of an FIR lodged by one namely, SI (P) Khanjanyoti Choudhury, of Chapar Police Station on 15.12.2024. The essence of allegation, against the accused is that he has kept one hand-made revolver loaded with 5 (five) nos of live round ammunitions, concealed in his house.

Mr. Karim, learned counsel for the accused submits that the accused was arrested on 15.12.2024, and till date he has been languishing in jail hazot for last 93 (Ninety three) days, and no charge-sheet has been submitted till date, and as such, Mr. Karim, has contended to allow the accused person to be enlarged on bail.
5. Mr. K. K. Das, learned Additional Public Prosecutor has produced the case diary before this Court and submits that investigation is yet to be completed.
6. Since the mandatory period of detention is already over and no charge- sheet has been submitted till date, the accused is entitled to default bail.
7. Accordingly, it is provided that on furnishing a bond of Rs. 50,000/- with one surety like amount to the satisfaction of the learned trial Court, the accused be enlarged on bail.
8. In terms of above, this bail petition stands disposed of.
