JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17 09-01-2025 In pursuance to the order of this Court dated 21.11.2024, the District Magistrate, Nawada has filed a counter affidavit, duly sworn by him, on 19.12.2024, wherein, in paragraph no.11, it has been stated that encroachment proceedings vide Encroachment Case No.02 of 2024-25 was initiated and thereafter, the encroachment in question including that existing adjoining to Patna High Court CWJC No.2119 of 2016(17) dt.09-01-2025 6/6 Hisua-Narhat Road has already been removed on 16.08.2024, hence the grievances of the petitioners have stood redressed. 2. Per contra, the learned counsels for the petitioners, in the aforesaid cases, submit that the encroachment in question has been removed partially, hence the petitioners be granted liberty to approach the District Magistrate, Nawada for redressal of their subsisting grievances. Liberty so sought is granted. 3. At this juncture, the learned counsels for the petitioners of the aforesaid cases further submit that in case the encroachment made over the khatiyani land of the petitioners by the Zila Parishad, Nawada/the Nagar Panchayat, Hisua is still existing, although it is the statement of the District Magistrate, Nawada that all the encroachments have been cleared, the petitioners be granted liberty to avail such other alternative remedies as are otherwise available under the law, for redressal of their subsisting grievances.
