ORDER 01.07.2025
01. The learned counsel for the petitioner when confronted with the maintainability of the instant writ petition as disputed questions of fact are involved, submitted that he would feel satisfied if the instant writ petition is disposed of at this stage with direction to the respondent No. 2-Deputy Commissioner, Baramulla, to accord consideration to the representation alleged to have been filed by the petitioners, within some reasonable time frame.
02. On the asking of the Court, Mr. Ilyas Nazir Laway, learned Government Advocate enters appearance on behalf of respondents and is not averse to the disposal of the
instant petition at this stage or else to the submission made by the counsel for the petitioner. However, he submits that the representation of the petitioner would be considered in accordance with the rules and as per law occupying the field.

Without commenting upon the merits of the instant writ petition and maintainability thereof, this Court deems it proper to dispose of the instant petition by directing the respondent No. 2-Deputy Commissioner, Baramulla, to accord consideration to the representation alleged to have been filed by the petitioner, within a period of six weeks from the date of receipt of copy of this order along with copy of writ petition and the annexures appended thereto, strictly in conformity with the rules and as per law.
04. Since representation has not been placed on record, the petitioner undertakes to file a fresh representation before the respondent No. 2-Deputy Commissioner, Baramulla, within a period of one week and subject to filing of fresh representation, the respondent No. 2 shall accord
consideration to the said representation within a period of six weeks from the date of receipt of copy of this order along with copy of writ petition and the annexures appended thereto, strictly in conformity with the rules and as per law. The order of consideration which is likely to be passed by the said respondent be provided to the petitioner through registered post.
05. Writ petition disposed of along with connected CM(s) in the manner indicated above.
06. The order of consideration which is likely to be passed by the said respondents be provided to the Petitioner No. 1 through registered post
