Learned counsel for the Petitioners states that inadvertently, the matter was dismissed, whereas the same ought to have been partly allowed. 4. In view of this, the following paragraphs be replaced with paragraph Nos.6 and 7 of the earlier order. “6. Admittedly, initially the application was filed under the Maharashtra Land Revenue Code, 1966 but the same was treated under the Mamlatdar’s wp6888.23(spm).odt 1 of 2 This Order is Speaking to Minutes order of order dated // Courts Act, 1906 by the Tahsildar/Mamlatdar. Thus, perversity is found in the order passed by the Tahsildar, Bhokardan. Therefore, on this ground alone I am inclined to quash and set aside the orders passed by the Sub Divisional Officer, Bhokardan, District Jalna and Tahsildar, Bhokardan. 7. In view thereof, the Writ Petition is partly allowed. The order dated 05.05.2022 passed by the Sub Divisional Officer, Bhokardan, District Jalna in Application No. 116/2021 and interim order dated 24.05.2021 passed by the Tahsildar, Bhokardan in case bearing Outward No. 2021/Jama-1/Kavi are quashed and set aside.” 5.
