[2025:RJ-JP:9881] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2493/2025 Mohammed Mainuddin Ansari S/o Late Shri Raju Ansari, Aged About 44 Years, R/o Village Rampurkashi Ward No. 12, Police Station Manihari, District Muzaffarpur, State Bihar. (Accused Presently Confined In Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Ms. Sonia Gill For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 05/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 25/2025 registered at Police Station Vishwakarma, District Jaipur City (west) for the offence under Sections 303(2) of BNS. Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. The main allegation of committing theft is against other co-accused. No recovery of stolen articles were effected from the present petitioner. It is alleged against the petitioner that he purchased the stolen articles and thereafter misappropriated them, no recovery of any motor parts etc were effected from the possession of present petitioner. Petitioner is a person of 44 years of age and against him there is no criminal antecedents. The accused- [2025:RJ-JP:9881] (2 of 2) [CRLMB-2493/2025] petitioner is in custody since long and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application. Heard and perused the material available on the record. Considering the arguments advanced by the counsel for the parties and looking to the fact that no recovery of stolen articles was effected from the petitioner’s possession and the main allegation of committing theft of truck No. RJ-41-GA-7414 is against other co-accused, therefore considering the above facts, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mohammed Mainuddin Ansari S/o Late Shri Raju Ansari, in connection with FIR No. 25/2025 registered at Police Station Vishwakarma, District Jaipur City (west) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
