HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 25300 of 2025 Court No. - 67 HON'BLE KRISHAN PAHAL, J.
1. List has been revised. 2. Supplementary affidavit filed today is taken on record. 3. Heard Sri Alok Saxena, Ms. Aanya Verma, learned counsels for the applicant, Sri Satyam Narayan, learned counsel for the informant, Sri Deepak Kumar Singh, learned A.G.A. for the State and perused the material placed on record. 4. Applicant seeks bail in Case Crime No.143 of 2025, under Sections 109(1), 118(1), 351(2) and 131 B.N.S., 2023 and Section 4/25 Arms Act, Police Station Civil Lines, District Meerut, during the pendency of trial. 5. As per prosecution story, the applicant alongwith other unknown persons is stated to have assaulted and caused grievous stab wounds to Rajiv Saini, Dilpreet Singh and Pradeep Tyagi on 16.06.2025 at about 10:45 p.m. The applicant was apprehended at the spot by the persons of the locality and was taken to the police station. 6. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about two hours, while the applicant is stated to have been apprehended at the spot at the time of incident only. So the said delay goes unexplained. Much reliance has been placed on G.D. dated 16.06.2025 of 21:10 hours, which indicates that the injured persons, namely, Rajiv Saini, Versus Counsel for Applicant(s) : Aanya Verma, Alok Saxena Counsel for Opposite Party(s) : G.A., Satyam Narayan Dev Arora .....Applicant(s) State of U.P. .....Opposite Party(s)
Dilpreet Singh and Pradeep Tyagi, reached the police station and they were sent for their medical examination at P.L. Sharma District Hospital, Meerut alongwith Home Guard 753 Avanish Kumar. 7. Learned counsel for the applicant has further argued that it is also mentioned in the very same G.D. of 9:10 p.m. that the assailant who had assaulted with knife is also present at the police station. The said G.D. falsifies the prosecution story as alleged in the FIR. Much reliance has also been placed on G.D. No.74 of 16.06.2025 itself, which was entered at 22:45 p.m., whereby it is mentioned that the applicant was taken by the informant alongwith Mahendra Singh Tyagi, Aditya Katiyar, Ark Bansal, Dilpreet Singh and Rajiv Saini at the police station, as such, it is a clear-cut case of false implication.
8. Learned counsel for the applicant has further argued that the matter has been settled between the parties. The informant has filed affidavit before the Investigating Officer, but prior to the said filing of affidavit, the final report (charge-sheet) had already been submitted in the case. There is no likelihood of conviction of the applicant in the instant case. There is no criminal history of the applicant. The applicant is languishing in jail since 17.06.2025 and he is ready to cooperate with trial. In case, the applicant is released on bail, he will not misuse the liberty of bail. 9. Per contra, learned counsel for the informant and learned A.G.A. have vehemently opposed the bail application but unable to dispute the
submissions raised by the learned counsel for the applicant.
10. Considering the facts and circumstances of the case, submissions made by learned counsel for the parties, the evidence on record, taking into
consideration the said delay and the interpolation in the two GDs of the institution of FIR and the GD of 09:10 p.m., and without expressing any opinion on the merits of the case, prima-facie the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
11. Let the applicant- Dev Arora, who is involved in aforementioned case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. Further, before issuing the release order, the sureties BAIL No. 25300 of 2025 2
be verified. (i) The applicant shall not tamper with evidence during trial. (ii) The applicant shall not pressurise/intimidate with the prosecution witnesses. (iii) The applicant shall appear before the trial court on the date fixed.
12. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
13. It is made clear that observations made in granting bail to the applicant shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses.
