This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.15 of 2025 registered at Police Station – Bodhghat, District -Bastar(C.G.) for the offence punishable under Section NISHA DUBEY Digitally signed by NISHA DUBEY 2 20(b)(ii)(b) and 20(b)(ii)(c) of the N.D.P.S. Act. 2. Case of the prosecution, in brief, is that on 12.11.2024 based on secret information received from Informer that some unknown person travelling in a bus is carrying illegal contraband for the purpose of sale, the police of Police Station-Purur, Balod intercepted the applicant and upon search of bag in possession of applicant, recovered 10.440 kg ganja and 2.60 kg charas. Applicant was asked to produce relevant documents with regard to possession of contraband, but he failed. Accordingly, the offence was registered against him and he was arrested. 3. It has been argued by the learned counsel for the applicant that the present applicant is innocent and has been falsely implicated in the crime in question. He submits that alleged contraband has not been seized from exclusive possession of applicant. He submits that the mandatory provisions of the NDPS Act have not been followed. Applicant is in jail since 08.01.2025 and he has no criminal past, therefore, he prays for grant of bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the quantity of Ganja & Charas seized is much more than the commercial quantity. 5. I have heard learned counsel for the parties and perused the 3 case diary. 6. In view of the aforesaid facts and circumstances, quantity of Ganja & charas seized from the possession of applicant, which is above the commercial quantity, and further that the investigation is under progress, the bail application of applicant- Rama Pangi involved in Crime No.15 of 2025, under Section 20(b)(ii)(b) and 20(b)(ii)(c) of the N.D.P.S.
