JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.252/2025 of Kothanur Police Station, registered for offences punishable under Section 318(4), 319(2), 336(2), 336(3), 340(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. - 3 - HC-KAR NC: 2025:KHC:47852 CRL.P No. 14596 of 2025 3. Learned counsel for petitioner would contend that, the allegation against this petitioner in the complaint is cheating the complainant because the petitioner is stated to be the assistant of accused No.1. The petitioner is not the assistant of accused No.1, but he is working as a Software Engineer. Accused No.1 has been granted anticipatory bail by this Court in Criminal Petition No.14619/2025 by order dated 10.11.2025. Therefore, the petitioner is entitled for grant of anticipatory bail on the ground of parity. With these, he prayed to allow the petition. 4. Per contra, learned Additional State Public Prosecutor for respondent would contend that, the investigation is in progress and the petitioner is required for interrogation. Having heard the learned counsels appearing for parties, the Court has perused the FIR and other materials placed on record. 6. Accused No.1 is alleged to have shown a flat to the complainant and insisted him to purchase the same stating that, it belongs to unknown person and the said complainant had purchased the same from unknown person under Sale Deed dated 12.09.2023. The petitioner/accused No.2 is stated to be the assistant of accused No.1. Accused No.1 has been granted anticipatory bail by this Court vide order dated 10.11.2025. Considering the same, the petitioner is also entitled for grant of anticipatory bail on the ground of parity. There are no criminal antecedents of the petitioner. The petitioner has undertaken to cooperate with the Police in investigation and abide by any conditions to be imposed by this Court. - 5 - HC-KAR NC: 2025:KHC:47852 CRL.P No. 14596 of 2025 7. Considering all the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following; ORDER The Criminal Petition is allowed. The petitioner/accused No.2 is granted anticipatory bail in Crime No.252/2025 of Kothanur Police Station and is ordered to be released on bail in the event his arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like- sum to the satisfaction of the Investigating Officer. ii) The petitioner shall voluntarily appear before the Investigating Officer within 10 days from this day and execute bail bond and furnish surety. iii) The petitioner shall cooperate with the Police in investigation and make himself - 6 - HC-KAR NC: 2025:KHC:47852 CRL.P No. 14596 of 2025 available for interrogation whenever required. iv) The petitioner shall appear before the Investigating Officer whenever called for. v) The petitioner shall not directly or indirectly make any inducement of threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence.
