The learned counsel for the respondent, after verifying, fairly submitted that the connected proceedings are pending only before the Principal Family Court, Coimbatore and he expressed no objection for the transfer request being acceded to, however, he requested to dispense with the physical presence of the respondent for all hearing dates. 3. Having heard the learned counsel for the petitioner as well and on going through the affidavit filed in support of the transfer petition, I am satisfied that the petitioner is entitled to an order of transfer withdrawing HMOP No.136 of 2025 from the file of Subordinate Judge, Omalur to the file of Principal Family Court, Coimbatore to be tried jointly with HMOP No.1810 of 2025. 4. Accordingly, this transfer petition is allowed with the following directions. (i) The proceedings in HMOP No.136 of 2025 is withdrawn from the file of Subordinate Judge, Omalur and the same are transferred to the file of Principal Family Court, Coimbatore to be tried jointly along with HMOP No.1810 of 2025. (ii) It made clear that the Principal Judge, Family Court, Coimbate shall not ordinarily insist on the presence of the parties, including the petitioner and the respondent, who shall be entitled to be represented by their respective counsel on hearing dates, except when their presence would be mandatory for __________ Page2 of 4 https://www.mhc.tn.gov.in/judis TR CMP No. 1284 of 2025 the purpose of examining them, in chief and cross.
