JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.3 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.299/2025 of H.A.L. Police Station, registered for offences under Section 126(2), 103(1), 190 of Bharatiya Nyaya Sanhita, 2023 read with Section 25(1b)(b) of Arms Act. 2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. Learned counsel for petitioner would contend that, no serious overtact is alleged against this petitioner. The act alleged against this petitioner is only assault by - 3 - HC-KAR NC: 2025:KHC:46709 CRL.P No. 14561 of 2025 legs to the deceased. The serious overtact is alleged against accused No.1 who assaulted with iron long chopper to the head of the deceased. The postmortem report indicates that, death is due to injury to the head. As the charge sheet is filed, the petitioner is not required for the custodial interrogation. There are no criminal antecedents of the petitioner. With these, she prayed to allow the petition. 4. Per contra, learned Additional State Public Prosecutor for respondent would contend that, the petitioner has assaulted the deceased with hands and legs along with other accused. The petitioner has no criminal antecedents. The car used for reaching the spot has been secured at the instance of this petitioner. The charge sheet materials show that, there is a prima-facie case against this petitioner for offences alleged against him. Having heard the learned counsels appearing for the parties, the Court has perused the charge sheet and other materials placed on record. 6. As per case of the prosecution, there was enmity between accused No.1 and the deceased. The deceased was troubling accused No.1 and therefore, he planned to kill the deceased. In furtherance of the said plan, accused Nos.1 to 5 on 18.06.2025 at about 01.00 a.m. when deceased was proceeding on his vehicle, accused No.1 stopped him and accused Nos.2 to 5 instigated accused No.1 to finish the deceased. At that time, accused No.1 assaulted the deceased with long chopper on his head and other accused persons assaulted the deceased with hands and legs. The deceased died on 05.07.2025. The postmortem report indicates that, the cause of death of the deceased is due to septicemia, as a result of a dangerous injury sustained. The serious overtact is alleged against accused No.1 who assaulted the deceased with a long chopper on his head and cause of - 5 - HC-KAR NC: 2025:KHC:46709 CRL.P No. 14561 of 2025 death is due to head injury. The overtact is alleged against this petitioner is assault by hands and legs. As the charge sheet is filed, the petitioner is not required for custodial interrogation. There are no criminal antecedents of the petitioner. 7. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following; ORDER The Criminal Petition is allowed. The petitioner is granted bail in Crime No.299/2025 of H.A.L. Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the Jurisdictional Court. - 6 - HC-KAR NC: 2025:KHC:46709 CRL.P No. 14561 of 2025 ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the Trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case. iv) The petitioner shall not involve in commission of any offence.
