Respondents CORAM: HON'BLE MR. JUSTICE SUVIR SEHGAL Present: Mr. J.S. Sekhon, Advocate for the petitioner. Mr. Vikas Arora, DAG, Punjab. *** SUVIR SEHGAL, J. (ORAL)
1. Instant petition has been filed under Article 226/227 of the Constitution of India, for issuance of a writ in the nature of mandamus directing the official respondents to entrust the investigation of complaints, Annexures P-4 and P-5, to a senior police official and to register FIR against private respondents No. 5 to 8.
2. Having heard counsel for the petitioner, this Court is of the view that the petitioner has an alternate remedy of filing a complaint under Section 175(3) of the Bhartiya Nagarik Suraksha Sanhita, 2023, before the competent Court. This Court, therefore, is not inclined to exercise the extraordinary writ jurisdiction under Article 226 of the Constitution of India.
3. Petition is dismissed.
4. Liberty is, however, granted to the petitioner to take recourse to the remedy available to him under the law. 21.07.2025
