THIS PETITION, COMING ON FOR HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE RAJESH RAI K ORAL ORDER 1. In this writ petition, the petitioners are seeking following relief: i) pass an order in the nature of an order of certiorari or any other order of like nature quashing the order dated 26.07.2016 passed by the respondent No.2 in Revision Application No.22/2014-15 confirming the order passed by respondent No.3 in RRT (A) 35/2012-13 dated - 4 - HC-KAR NC: 2025:KHC:45819 WP No. 53552 of 2016 04.08.2014 (vide Annexure-A) and consequently quashing the order dated 04.08.2014 (vide Annexure-B) passed in RRT (A) 35/2012-13 by the respondent No.3 and thereby allow the Writ Petition; ii) direct the respondents No. 2 to 4 restore the MR No.183/2010-11 in respect of the schedule property; iii) to pass such other relief as the Court may deem fit to grant under the facts and circumstances of the above case. 2. The grievance of the petitioners is that there is a suit in O.S.No.234/2013 pending in respect of Sy.No.259/1 measuring 33 guntas situated in Mandakalli Village, Kasaba Hobli, Mysore Taluk, against the petitioners for the relief of declaring the mutation order passed in M.R.No.183/2010-11 as null and void and for consequential perpetual injunction. During the pendency of the suit, the Assistant Commissioner has passed an order dated 04.08.2014 in RRT (A) 35/2012-13 filed by respondents 5 to 8 by cancelling the mutation in - 5 - HC-KAR NC: 2025:KHC:45819 WP No. 53552 of 2016 M.R.No.183/2010-11 and also directing both the parties to approach the Civil Court seeking declaration. The said order was challenged by the petitioners before the Deputy Commissioner in Revision Application No.22/2014-15, wherein the Deputy Commissioner affirmed the said order. 3. Being aggrieved by the portion of the said order i.e., direction for filing a suit seeking declaration by both the parties, the petitioners are before this Court. 4. Heard Sri P.K.Shrikara, learned counsel appearing for the petitioners, Sri Neelakantappa K.Pujar, learned HCGP for respondents 1 to 4 and Sri P.L.Rajesh, learned counsel appearing for respondents 5 to 8. 5. On careful perusal of the records, it could be gathered that the Assistant Commissioner while passing the impugned order has observed that there is a civil suit pending between respondents 5 to 8 and the petitioners in respect of aforesaid mutation entry and for consequential relief of perpetual injunction. Such being the position, the - 6 - HC-KAR NC: 2025:KHC:45819 WP No. 53552 of 2016 Assistant Commissioner ought not to have passed the order directing the parties to approach the Civil Court seeking relief of declaration. On appeal, the Deputy Commissioner has also affirmed the said order without applying his mind in respect of said portion of the order. 6. The petitioners fairly submit that they have no grievance in respect of cancellation of mutation entry since the same was the subject matter of suit pending for consideration before the Civil Court. In such circumstances, the prayer of the petitioners required to be considered. Accordingly, the writ petition is allowed in part. The order dated 04.08.2014 passed by the Assistant Commissioner vide Annexure-B and the order dated 26.07.2016 passed the Deputy Commissioner vide Annexure-A are quashed to the extent of directing the parties to file a suit for declaration. However, as regards cancellation of aforesaid mutation entry in M.R.No.183/2010-11 is concerned, it is made clear that - 7 - HC-KAR NC: 2025:KHC:45819 WP No. 53552 of 2016 the same would be subject to the result of suit in O.S.No.234/2013.
