Petitioner claims that an overhead water tank is being constructed over the bhumidhari land of petitioner without granting any compensation for acquiring the land under Jal Jivan Mission Yojna. According to petitioner, earlier proceedings were objected and constructions were stopped, but again the construction is being carried out by authorities over the bhumidhari land of petitioner. 2. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit. The petitioner is directed to move a representation before Sub Divisional Magistrate, Tehsil-Martinganj, District-Azamgarh within 15 days from today. In case, the said representation is filed within the said period, respondent no. 2 shall decide the same, strictly in accordance with law, after hearing all affected parties, within a period of next one month. 3. With the aforesaid directions, writ petition stands disposed of. 4. It is made clear that this Court has not adjudicated the matter on merits.
