CORAM:
HON’BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE
O R D E R 05.06.2025 Question was raised with regard to the maintainability of this petition because petitioners have filed instant petition under Section 227 of the Constitution of India against the decree passed way back in the year 2023/ 2024, without availing the remedy of appeal.
Learned counsel for the petitioners, facing above situation, seeks withdrawal of writ petition and submits that petitioners may be given liberty and liberty is granted subject to availability of remedy under law. Dismissed as withdrawn with liberty as prayed for.
