No.2, application for exemption from filing typed copy of the documents as he has filed typed and legible copies of the documents. 3 In view of the above, I.A. No.2 is dismissed as not pressed. YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2025.02.07 17:43:44 +0530 2 4 By way of this writ petition, the petitioners have prayed for following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to issue appropriate writ and direct that the petitioner is eligible to be called for counselling in the interest of justice. 10.2 That, the Hon’ble Court may kindly be pleased to issue appropriate writ and direct that the respondent authorities to declare the petitioner as eligible to participate in the counselling process for the post on which the petitioner has applied on the basis of merits, ranks and marks secured by the petitioner. 10.3 That, the Hon’ble Court may kindly be pleased to issue appropriate writ and direct that the respondent authorities to decide the petitioner representation within such outer time limit as the Hon’ble Court may deem fit in light of facts and circumstances of the case. 10.4 Any other relief which this Hon’ble Court deem fit and proper may also kindly be granted to the petitioner in the interest of justice.” 5 Learned counsel for the petitioner submits that the petitioner who belongs to Scheduled Tribe (“ST”) (Particular Vulnerable Tribal Community) is not being considered for the post of Assistant Teacher, as per the notification dated 20.02.2014. The advertisement has been issued by the School Education Department for various districts, wherein total 3758 posts are reserved for ST category and 20% of the ST posts are reserved for the PVTG category, therefore, the candidature of the petitioner has to be considered for the post of Assistant Teacher in light of the circular dated 20.02.2014. He submits that similar identical petitions have also been decided in light of the said circular and appointment orders have been issued to the similar situated candidates. 3 He also submits that the petitioner may be given liberty to file a representation raising all their grievances before the concerned respondent authority to consider and decide their claim within stipulated time. 6 Learned counsel appearing for the State does not opposes the said submission. 7 Considering the submissions made by the parties, and further considering the aforesaid aspect of the matter, the petitioner is granted liberty to file a representation raising all their grievances before the authorities concerned within a period of 10 days from the date of copy of this order and, in turn, the concerned respondent authority is directed to consider and decide the said representation of the petitioners while passing appropriate order in a pragmatic manner within a period of 15 days from the date of receipt of such representation, in accordance with law, keeping in mind the circular dated 20.02.2014 and further considering this fact that similarly situated Teachers have already considered and they were given appointment order. 8 With the aforesaid observation(s)/direction, the instant petition is hereby disposed off.
