JUDGMENT AND ORDER (ORAL)
1. Heard Mr. S. Kumar, learned counsel for the respondent/accused, who has submitted that the respondent/accused is since deceased, and an affidavit in this regard has been filed, enclosing copy of the death certificate and marked as Annexure-II. The accused person is said to have expired on
29.12.2024. Accordingly, it is prayed that nothing survives in this case and necessary orders may be passed.
2. Dr. N. Mozika, learned DSGI assisted by Mr. J.I. Nongrum and Ms. R. Fancon, learned counsel for the petitioner/Union of India has conceded to the prayer made, but has however submitted that, while disposing of this petition, the Trial Court may be directed to take cognizance of the fact that the respondent/accused is since deceased and to pass necessary orders in this regard.
3. Accordingly, on consideration of the submission made, this Court hereby disposed of this petition as infructuous on the ground that nothing survives against the respondent/accused, who is since deceased. As submitted, the learned Trial Court is to take cognizance of this fact and to 2025:MLHC:211

pass necessary orders as far as the trial is concerned.
