Neutral Citation No. - 2025:AHC:82687 Court No. - 47 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 26594 of 2024 Applicant :- Ankit @ Indu Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Ramesh Kumar Pandey Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard learned counsel for the applicant; learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Ankit @ Indu, with a prayer to release him on bail in Case Crime No. 628 of 2023, under Sections 376-AB, 506 IPC and 5M/6 POCSO Act, Police Station Modi Nagar, District- Ghaziabad, during pendency of trial. There are allegations against the applicant of committing the offence of rape and criminal intimidation against a minor girl.
Learned counsel for the applicant has submitted that applicant has falsely been implicated in this case. Learned AGA has vehemently opposed the prayer for bail of the applicant and has submitted that the applicant has criminal history of three cases to his credit and two of them relate to the same offence. This Court, after hearing the learned counsels for the parties, does not finds any ground for enlarging the applicant on bail at this stage. The bail application is, accordingly, rejected. The trial court is directed to conclude the trial against the applicant, as expeditiously as possible, as per Section 346 B.N.S.S./309 Cr.P.C.
