Heard learned counsel Mr.D.Sarmah for the petitioner, Rupam Sharma who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 05.02.2025 in connection with Narayanpur P.S.Case No. 06/2025 (GR No. 113/2025) under Sections 64(1)/69/81/49 of the

The allegation against the petitioner is that he had love relationship with the victim and induced the victim to have physical relationship with him with false promises of marriage. The petitioner impregnated the victim and finally the victim gave birth to a baby girl. On several pretexts, the petitioner avoided to marry the victim. 3. It is further submitted on behalf of the petitioner that a false case has been brought up against him by the victim. It is also submitted on behalf of the petitioner that he is only 19 years old and he will not be able to marry the victim more so when another person had impregnated the victim. It is submitted that the other person has already been arrested in connection with this case. DNA samples have been taken from both the petitioner and the other person for forensic examination. 4. I have also scrutinized the case diary. 5. The merits of this case are not brought to the fore as investigation is still under progress. It is submitted that the petitioner is willing to co-operate with the remaining part of the investigation. He has pledged to abide by any stringent bail conditions if imposed upon him. 6.
The petitioner, named above shall be enlarged on bail on furnishing a bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, North Lakhimpur, Lakhimpur under the conditions that:- (i) That the petitioner shall appear before the Investigating Officer and co-operate with investigation,
Page No.# 3/3 (ii) That the petitioner shall not exercise any threats to victim or witnesses, (iii) That the petitioner shall not leave the jurisdiction of the Court without prior permission. 7. On breach of any of the bail conditions, bail granted to the petitioner will stand automatically cancelled. 8. In terms of the above observation, this Bail Application stands disposed of. 9.
