ORAL ORDER
The limited prayer in the petition is to grant two months time to deposit 20% of the fine amount before the Appellate Court in Crl.A.No.84/2025.
2. Petitioner/accused was convicted by the trial Court for an offence punishable under Section 138 of Negotiable Instruments Act, vide
judgment dated
21.8.2025. He was sentenced to pay fine of Rs.20 lakhs, in default of payment of fine, to undergo simple imprisonment for a period of two years.
3. In the appeal preferred by the petitioner/accused, the learned Sessions Judge vide order dated 18.9.2025 was pleased to suspend the sentence subject to certain conditions, including that the accused shall deposit 20% of the fine amount before the trial Court within 30 days.

Learned counsel for the petitioner submits that since the fine amount is huge, the petitioner was not able to arrange the amount to deposit in time and therefore, submits that time as prayed may be granted.
5. The appeal preferred by the accused is pending before the Appellate Court, which has to be heard on merits. Since the petitioner has undertaken to deposit 20% of the fine amount, in the interest of justice, this Court deems it fit to grant some reasonable time. Hence, the following:
ORDER
i. The time granted for depositing 20% of the fine amount in Crl.A.No.84/2025 by the VII Additional District and Sessions Judge, Tumakuru, vide its order dated 18.9.2025 is hereby extended by a period of 3 weeks from today, which will expire on 26.11.2025. The amount shall be paid on or before 26.11.2025.

ii. If the amount, as directed is not deposited, the learned Sessions Judge shall proceed in accordance with law.
iii. Petition is disposed of.
