This application has been filed seeking anticipatory bail in Case Crime No. 39 of 2024, under Sections 420, 467, 468, 471, 406, 120B I.P.C., P.S. Bewar, District Mainpuri. 3. At the outset, Sri Neeraj Kumar Sharma, learned AGA submits that investigation is still pending against the applicant. The applicant is not co-operating in the investigation. He is absconding and evading the process of law. Consequently, non- bailable warrant has been issued against the applicant on 16.3.2024. Thereafter, process under Section 82 Cr.P.C. has also been issued against him on 29.11.2024. On that ground, he submits that the applicant is not entitled to be enlarged on anticipatory bail. 4. Heard counsel for the applicant, learned A.G.A. for the State and Sri Sanjeev Kumar Pandey, counsel for the informant. Perused the material placed on record. 5. A perusal of C.D. Parcha no. 32 dated 29.11.2024 and C.D. Parcha No. 9 dated 17.3.2024 indicates that the investigation is pending against the applicant. The applicant is not co-operating in the investigation. He is absconding and evading the process of law. On 16.3.2024 non-bailable warrant was issued against the applicant and on 29.11.2024 process under Section 82 Cr.P.C. has been issued. Further, issuance of process under Section 82 Cr.P.C. against the applicant has not been disputed by the counsel for the applicant. 6. Since the applicant has remained out of reach of the investigating agency, this Court is not inclined to interfere in the present application. 7. The application is hereby rejected.
