(oral) Learned counsel for the respondent states that the respondent has deposited the entire arrears of maintenance. This fact is duly admitted and acknowledged by the learned counsel for the petitioner.
2. Since the respondent has paid the entire amount of maintenance and this petition is directed against the order of interim maintenance, therefore, we are of the considered view that ends of justice would be met in case a direction is given to
( 2025:HHC:6778 ) the learned trial Court to decide the case pending before it expeditiously.
3. Accordingly, without entering into the merits of the case, we direct the learned trial Court to decide the case pending before it as expeditiously as possible and in no event later than 31.05.2025.
4. Irrespective of the next date of proceedings fixed by the learned trial Court, we deem it appropriate to direct both the parties to appear before the learned trial Court on 24.03.2025. Ordered accordingly.
5. In view of the above, the petition, so also pending application(s), if any, stands disposed of. ( Tarlok Singh Chauhan ) Judge ( Sushil Kukreja ) 20th March, 2025 Judge (raman/sumit)
