2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail to the petitioners 1. Bolaram Das & Sri Anita Das in respect of Samaguri PS Case No. 32/2025.
3. A widow had a relationship with the present petitioner, Bolaram Das. Because of their relationship, she became pregnant on three occasions and on each occasion her pregnancy was aborted by medicines. Thereafter, she became pregnant for the fourth time. The second petitioner Anita Das is the mother of the first petitioner Bolaram Das. The informant has claimed that Anita Das had taken her son to a place, where both of them are hiding. In the FIR itself, the informant stated that whenever she got her pregnancy aborted, the petitioner Bolaram Das used to pay her money.
4. I have considered the submissions made by the learned counsel of both sides.
5. Therefore, this Court is of the opinion that under the given circumstances of the case, the petitioners do not deserve to be detained in custody. Therefore, their bail application is allowed.
6. It is hereby directed that in the event of arrest in connection with Samaguri P.S. Case No. 32/2025, the petitioners, 1. Bolaram Das & Sri Anita Das shall be released on bail of ₹20,000/- each with sureties of like amount to the satisfaction of the arresting authority. With the aforesaid direction, the pre-arrest bail application stands disposed of.
