JUSTICE ANU SIVARAMAN and HON'BLE MR. JUSTICE RAJESH RAI K ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) This Civil Contempt petition is filed alleging non-compliance of the directions contained in the common judgment dated 26.09.2022 in W.P. No.55227/2018. The compliance affidavit dated 12.08.2025 has been placed on record stating that an official memorandum has been issued on 12.01.2024 stating as follows; "3. I respectfully submit that, in compliance with the above directions of this Hon'ble High Court, necessary steps have been undertaken by issuing official memorandum bearing No.BRDC- LNDGOLND/7/2024-LNDGRNTSDBP dated 12.01.2024 reserving 5 acres of land in Sy.No.24 of Channadevi Agrahara Village, Madhure Hobli, Doddaballapur Taluk for developing a layout for making allotments in favour of ex-servicemen in accordance with applicable law. A copy of the official memorandum dated 12.01.2024 is enclosed herewith as ANNEXURE-R1. It is respectfully submitted that the Rajeev Gandhi housing corporation limited has been requested by letter dated 21.05.2025, to release necessary funds amount to Rs.1,68,000/- required for the - 4 - HC-KAR NC: 2025:KHC:34885-DB CCC No. 1010 of 2023 formation of the layout. A copy of the said letter is enclosed as ANNEXURE-R2. Immediately upon release of the funds, necessary steps will be taken to form the layout and allot sites accordingly. 4. Further I respectfully submit that another 5 acres of land in Sy.No.1 of M.Sathyavara Village, Sulibele Hobli, Hosakote Taluk, Bangalore Rural District is also reserved for developing a layout for allotting sites to Ex-Servicemen, and the required funds have already been released by the Rajeev Gandhi housing corporation limited and the same has been intimated to this office vide letter dated: 16.04.2025. The copy of the letter received from Rajeev Gandhi housing corporation limited is enclosed as ANNEXURE-R3 releasing Rs.1,56,000/-. The formation of the layout is expected to be completed shortly. Immediately after the completion of the layout and upon demarcation of the sites, steps will be taken to allot sites in that layout. 5. Therefore, it is respectfully submitted that in accordance with Gazette notification No.RD 26 LGP 202 dated 27.10.2021 sites will be allotted either in the layout to be formed in Sy.No.24 of Channadevi Agrahara Village, Madhure Hobli, Doddaballapura Taluk, or in the layout (whose formation will be completed shortly) in the land in Sy.No.1 of M.Sathyavara Village, Sulibele Hobli, Hosakote Taluk. Whichever layout out of the above two the complainant selects, the allotment will be made accordingly." - 5 - HC-KAR NC: 2025:KHC:34885-DB CCC No. 1010 of 2023 2. In view of the compliance affidavit, this contempt proceeding is dropped. It is made clear that in case the complainant submits his option with regard to allotment of land, same shall be considered and appropriate steps shall be taken to allot land to the complainant, within three months from the date on which such a request is made before the competent authority.
