Heard the learned counsel for the petitioner and learned counsel for the State. Perused the material available on record and also gone through the impugned order.

This bail application has been filed to release the petitioner on regular bail in connection with Giridih (Mahila) Police Station Case No.13 of 2021 corresponding to Sessions Trial No.13 of 2022 and POCSO Case No.88 of 2023 pending in the Court of Special Judge, POCSO Act, Giridih, for offences under Sections 376/ 120(B)/ 506/34 of the Indian Penal Code.

The petitioner renews his prayer for bail pursuant to
order dated 08.12.2022 passed in B.A. No.12434 of 2022, whereby this Court had rejected the prayer for bail of this petitioner granting him liberty to renew his prayer after the victim is examined.

Learned counsel representing the petitioner submits that the victim has already been examined in this case. The deposition of the victim has been brought on record.

Opportunity was given to the State to oppose the bail application, which the State availed and opposed.

After going through deposition of the victim and considering the earlier order dated 08.12.2022, I am inclined to release this petitioner on bail.

Accordingly, the present Bail Application is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Giridih, subject to the condition that the petitioner will appear and mark his attendance before the Trial Court, as and when directed. If he fails to appear in any particular period, his bail bonds shall stand cancelled and steps should be taken to arrest the petitioner.
