Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State respondent. This application is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for setting aside and/or quashing of the Order dated 05.02.2025 passed by the learned Judicial Magistrate, First Class, Kamrup (M), Guwahati in Dispur P.S. Case No. 1162/2024 (G. R. Case No.6345/2024) under Sections 61(2)(a)/317(2)/303(2)/310(4) of the BNS. Mr. Baruah, learned Additional Public Prosecutor, submits that though the case was listed today for production of the Report before this Court, but the I.O. has already filed Charge-Sheet in this case, vide Charge-Sheet No. 959/2024, dated 31.12.2024. Considering the submission of the learned Additional Public Prosecutor and the fact that the case has already been charge-sheeted vide Charge-Sheet No. 959/2024, dated 31.12.2024, the petitioner is hereby directed to file a zimma petition before the learned Court below, which shall consider the same in accordance with the law.
