The petitioners before this Court are the defendants in a suit for specific performance of an agreement of sale. The suit came to be decreed and the first appeal came to be dismissed on 29.03.2022. The second appeal came to be filed before this Court on 02.12.2025. The reason adduced by the petitioners for not filing the appeal in time is that the counsel who represented them in the first appeal as well as in the execution proceedings did not inform them about the disposal of the first appeal. https://www.mhc.tn.gov.in/judis CMP No. 31308 of 2025 __________ Page2 of 3 3. Notice has been served on the respondent. Mr.T.S.Kanmani, learned counsel for the respondent stoutly opposed the petition for condonation of delay and submitted that the reasons assigned by the petitioners are false and frivolous. During the pendency of the delay condonation petition, the petitioners forcibly dispossessed the plaintiff from the suit property. However, this issue can be gone into at the stage of the second appeal. At present, the mistake committed by the counsel cannot be put against the client. 4. Hence, this Civil Miscellaneous Petition is ordered and the delay of 1246 days is condoned on payment of cost of Rs.10,000/- (Rupees Ten Thousand only) to the learned counsel for the respondent, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court.
