Nagarale Santosh Subhashchandra, learned counsel for the petitioner and Sri. A. Madhusudhan Rao. 2. Present petition is filed by the petitioner/husband under Section 24 of the Code of Civil Procedure against his wife with the following prayer : " Wherefore, the petitioner most humbly prays that, this Hon'ble court may be pleased to transfer the petition in M.C case No. 127/2025 pending on the file of the learned principal judge family court, at Chikmagalur to the - 3 - HC-KAR NC: 2025:KHC:52575 CP No. 295 of 2025 learned Principal Judge family court at Bengaluru, in the interest of justice and equity." 3. Facts in the nutshell which are utmost necessary for disposal of the present petition are as under: 3.1 On account of the strained relationship between the parties, wife has filed a petition under Section 9 of the Hindu Marriage Act before the Principal Judge, Family Court, Chikkamagaluru in M.C.No.127/2025 seeking restitution of conjugal rights. 4. Husband is seeking the transfer of the said case to Court at Bangalore on account of geographical distance. 5. Sri. A. Madhusudhan Rao, learned counsel for the respondent opposes the transfer grounds. 6. Having heard the arguments of both sides, this Court perused the material on record meticulously. 7. It is to be noted that geographical distance is no longer valid parameter for transfer of pending case from - 4 - HC-KAR NC: 2025:KHC:52575 CP No. 295 of 2025 one Court to another Court in view of the video conferencing facility. 8. If the petitioner files an application before the court at Chikkamagaluru seeking permission to effectively participate in the pending proceedings through video conference, the same shall be allowed by the Court at Chikkamagaluru. 9.
