Learned counsel for the petitioner contended that the petitioner has been falsely implicated in the present case. The petitioner is in custody since 13.03.2025. Nothing is to be recovered from the petitioner. He urged that as trial of the case is likely to take time, therefore, the petitioner be granted concession of regular bail. Notice was issued in this case on 16.07.2025 and status report was called from the State, which was filed on 27.08.2025 and the same is taken on record. Learned State counsel has opposed the petition and submitted that allegations against the petitioner are serious in nature. During investigation, the petitioner and others were apprehended with 100 grams of heroin and Rs.5,000/- as drug money without any permit or licence and as such he is not entitled to the concession of regular bail. Heard. The petitioner was allegedly found to be in conscious possession of 100 grams of heroin and cash of Rs.5,000/-, which falls under the 'non commercial quantity'. It is a matter of trial, whether the amount of Rs.5,000/- allegedly recovered from the petitioner was drug money or not. Challan in the present case has already been presented before the trial Court and charge in this case is yet to be framed against the petitioner and the other co-accused. As per the custody certificate, the petitioner is in custody since 06 months. Conclusion of trial is likely to take time, so no useful purpose would be served by further detaining the petitioner behind the bars. Accordingly, the present petition is allowed and the petitioner is ordered to be admitted to regular bail, on furnishing adequate bail bonds KOMAL 2025.09.11 18:25 I attest to the accuracy of this document
