This CONTC arises out of the order dated 05.03.2025 passed by this Court in W.P.(C) No.3230 of 2025. 3. Pursuant to the order of this Court dated 11.11.2025, the Principal Chief Conservator of Forest & HoFF, Odisha/Opposite Party No.2 is present in person before this Court. 4. The relevant portion of the said letter is extracted hereinbelow:- “In inviting a reference to the above letter on the subject cited, I am to submit the following facts towards compliance of the order dated 05.03.2025 arising out of W.P. (C) No.3230 of 2025, as the Contempt Application was taken up before the Hon'ble Court on 11.11.2025. 1. That, the petitioner has filed the aforesaid Writ petition before the Hon'ble High Court, Odisha, seeking direction to the Opp. Party, more particularly to the Opp. Party No.2, i.e. Principal Chief Conservator of Forests & HoFF, Odisha, Bhubaneswar to recommend on the application of the petitioner for rehabilitation of Saw Mill by the concerned authority. 2. That, as per the direction of Hon'ble High Court, Orissa, the Opp. Party has submitted necessary instructions to the Advocate General, Odisha, Cuttack vide this office letter No.4769 dated 28.02.2025, letter No. 15750 dated 28.07.2025, letter No.18385 dated 03.09.2025, letter No.20645 dated 09.10.2025 and letter No.22534 dated 06.11.2025 respectively. 3. That, as per the decision taken in the State Level Committee (SLC) meeting held on 24.09.2025 under the chairmanship of the Principal Chief Conservator of Forests &HoFF, Odisha, wherein the case of M/s Dakhineswari Saw Mill was placed in category II and recommended for rehabilitation after approval of Digitally Signed Signed by: GITANJALI NAYAK Reason: Authentication Location: OHC Date: 03-Dec-2025 18:17:47 Signature Not Verified Page 3 of 4. condonation by the Government of Odisha, Forest, Environment &CC Department as per the Guidelines of Forest & Environment Department vide Notification No.10F (Legal) 03/2011- 13891/F&E dated 30.11.2011. Meanwhile, the condonation proposal of M/s Dakhineswari Saw Mill was moved to Government, Forest, Environment & Climate Change Department through OSWAS file dated 24.10.2025 for necessary approval. 4. That, after careful consideration, the Government, FE&CC Department, vide letter No.FE-PRO- FPRO-0016-2025-34446/FE&CC Dated 24.11.2025 have approved the proposal of condonation as per the provision laid down in Para-3(b) of the Guidelines issued in Forest & Environment Department vide Notification No.10F(Legal)03/2011-13891/F&E Dated 30.07.2011. 5. That, on receipt of said approval letter from Government, FE&CC Department the Opp Party No.02 has taken immediate steps by seeking Option for choice of notified industrial estates from the petitioner Sri Babulal Patel of M/s Dakhineswari Saw Mill vide this office letter No.PCCFO-PSM- MISC-0065-2025-23760 Dated 26.11.2025 (Annexure-1) for onward transmission to the Chief General Manager (MSME) IDCO, Bhubaneswar for allotment of land for establishment, relocation and functioning of the Saw Mill. 6. It is apparent from the letter No.23906/1F(FU&FP)(FP)25/2025 dated 27.11.2025 issued by the Principal Chief Conservator of Forest & HoFF, Odisha/Opposite Party No.2 that the Principal Chief Conservator of Forest & HoFF, Odisha/Opposite Party No.2 has already taken steps by following all procedure to carry out the order of this Court. 6. Hence, this CONTC is disposed of being dropped. 7. Personal appearance of the Principal Chief Conservator of Forest & HoFF, Odisha/Opposite Party No.2 is dispensed with.
