Petitioner has filed instant 2nd petition under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.130 dated 10.09.2021 under Sections 452, 323, 354-A, 427, 148 and 149 of IPC registered at Police Station Bassi Pathana, District Fatehgarh Sahib. 2. As per facts of the case, complainant gave her statement that she is married to Davinderpal Sharma who is running utensils shop in the main Bazaar, Nandpur Kalour. On 08.09.2021, Zora Singh had taken away a plastic pan from the shop and in the evening at about 5/6 pm came back to their shop that there was some defect in the plastic pan and he wanted to return the same and take back his money. Zora Singh consumed liquor and hurled abuses to her husband and later-on fled away from the spot. Her husband returned home and narrated the entire story to her. After some time somebody rang door bell and when she opened the door Zora Singh armed with rod, his son armed with rod another Zora Singh son of Baljit Singh armed with baton, Deepi armed with iron pipe along with unidentified person came there. Zora Singh gave beating to her with the rod. On alarm raised by her, Zora Singh caught hold of her shirt and touched her with an intention to outrage her modesty. On hearing the alarm, her nephew Ravi Kumar reached there who tried to rescue her but they further assaulted him. They managed to run away from the spot. 3. Learned counsel for petitioner denied the allegations. It is pointed out that he was granted interim relief by the Coordinate Bench vide order dated 13.08.2024. Thereafter, he has joined the investigation in pursuance of order dated 27.02.2025 and he has fully cooperated with the Investigating Agency. It is submitted that his anticipatory bail application may be allowed. 4. Status report filed. It is submitted that on the statement of complainant present FIR has been registered whereas on the statement of present petitioner cross-case has been registered bearing DDR No.35 dated 14.09.2021 under Sections 341, 323, 34 IPC against Davinderpal Sharma husband of complainant, Amit Kumar and Ravi Kumar. It was alleged that petitioner was required to join the investigation. However, later petitioner joined the investigation and the rod is also recovered and it is confirmed by learned counsel representing State that petitioner is not required for further investigation as per the instructions of Investigating Officer. Petitioner has joined the investigation and the alleged weapon of offence is also recovered. Since he has fully cooperated, therefore, he is not further required for investigation of the case. He is still ready and willing to join investigation as and when required. No purpose would be served by sending him behind the bars. Considering the aforesaid factual position, anticipatory bail application filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023. 6. Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
