After arguing for a while, the learned counsel for the petitioner submits that he has instructions from his client that he will deposit 10% of the OTS amount before the bank within two days positively and he further undertakes that the full amount in terms of OTS shall be deposited in aggregate within three months’ time in conformity with the terms and conditions of the special scheme, which has been formulated by the bank, for one time settlement of non- performing assets, through the medium of the OTS. 2. The aforesaid position has been reflected in the JKB Special OTS-2024 Scheme dated 30th January 2025 and has also been extended till 1st September 2025 by virtue of a subsequent circular bearing No. 17745 issued by the bank on 2nd July 2025. Copy of circular dated 2nd July, 2025 is taken on record. 3. The petitioner further undertakes to comply all the terms and conditions of the OTS scheme and in the light of the statement made by the learned counsel for the petitioner which has been accepted by the learned counsel for the bank, no fruitful purpose would be served by keeping this petition pending and accordingly, the same is disposed of in the light of the statement made to the effect that the petitioner will deposit 10% of the amount within two days, which has been accepted by the learned counsel appearing on behalf of the respondent Bank. 4. It ismade clear that in case the petitioner deposits minimum of 10% of the OTS amount within two days as mentioned hereinabove, then the benefit of OTS scheme shall be extended to the petitioner, subject to the fulfillment of all other conditions envisaged in the OTS scheme followed by the circular. 5. It is further made clear that the direction so passed, is in the peculiar facts and circumstances, which has been projected in the instant case and should not be made a precedent in other cases. 6.
