For Petitioner : Mr.T.S.Vijaya Raghavan For Respondents : Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal side) High Court of Madras Assisted by Mr.Mohammed Imran.A O R D E R This writ petition has been filed for direction directing the respondents 2 and 3 to offer adequate protection to remove the flag post illegally erected in the entrance of petitioner’s property abetting the road, preventing the petitioner from peacefully enjoying the property situate in T.S.No.9/4, Ward J, Block 18, Salem Town and District. 2.The learned counsel for the petitioner submitted that pending writ petition, the flag post was removed and compound wall was constructed in and around the petitioner’s property. That apart the petitioner also filed suit for declaration and consequential relief in O.S.No.744 of 2016 on the file of the Court of the District Munsiff, Salem and it was also decreed in favour of the petitioner in respect of 2/4 https://www.mhc.tn.gov.in/judis W.P. Crl. No.1554 of 2025 the subject property. However, once again the counter party has trespassed into the petitioner’s property and demolished the compound wall and warned that they will once again erect their party pole during the independence day. 3.Admittedly, now the flag post erected by the counter party has been removed. If any third party indulge in erecting their party pole in the land owned by the petitioner, the petitioner is at liberty to lodge complaint before the third respondent. On receipt of the said complaint, the third respondent is directed to take appropriate action against the counter party if any cognizable offence is made out, in accordance with law. 4.The writ petition is disposed of.
