2. This appeal is directed against the order dated 22.02.2025 passed by the learned Sessions Judge, Pakur, in A.B.P. No. 34 of 2025 arising out of Hiranpur P.S. Case No. 63 of 2021, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
3. It has been alleged that the tractor of the appellant was seized as the same was involved in illegal mining. The only allegation against the appellant therefore seems to be hiring of the tractor for the purposes of mining.
4. On consideration of the aforesaid facts, we, while setting aside the order dated 22.02.2025 passed by the learned Sessions Judge, Pakur, in A.B.P. No. 34 of 2025 arising out of Hiranpur P.S. Case No. 63 of 2021, direct the appellant, above named, to surrender before the learned Trial Court within a period of four weeks and on his surrender, the learned Trial Court shall release him on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Pakur in connection with Hiranpur P.S. Case No. 63 of 2021.
5. This appeal is allowed.
