Mr. Shariq Khurshid, learned counsel for the applicant. 2. Mr. Pankaj Joshi, learned AGA with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant ‘’Salman, son of Ayyub” is praying for regular bail in relation to First Information Report dated 19.04.2025 bearing FIR No. 0158 of 2025, Police Station – Kashipur, District – Udham Singh Nagar wherein present applicant along with two others Adil and Khalid were implicated for the offences punishable under Section 143 of BNS, 2023 and Section 3, 4, 5, 6 and 7 of the Immoral Trafficking (Prevention) Act, 1956. 4. It is contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated, which is evident from the fact that none of the victim disclosed the name of the applicant and the charge sheet has been filed without collecting material evidence. 5. Apart from this, he submits that applicant is languishing in jail since 19.04.2025 and have no previous criminal history and other co-accused Rajesh @ Raju, whose name was disclosed by the victim during investigation was granted interim bail by the Coordinate Bench in ABA No. 840 of 2025. He further submits that since the charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant. 6. On the other side, Mr. Pankaj Joshi, learned AGA, have not disputed this fact that since the charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and applicant have no previous criminal history and other co accused Rajesh @ Raju, has already been granted anticipatory bail by the Coordinate Bench in ABA No. 840 of 2025. 7. After hearing the arguments of learned counsel for the parties and further taking into 2025:UHC:7146 consideration the fact that since the charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and other co-accused Rajesh @ Raju was granted interim bail by the Coordinate Bench in ABA No. 840 of 2025 and applicant has no previous criminal history, this Court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘’Salman, son of Ayyub” be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
