NATARAJ ORAL ORDER The petitioners have sought for a writ in the nature of mandamus to direct the respondent No.5 to remove the notice board erected on the schedule property bearing survey No.51 of Mallasandra Village, Yeshwanthpur Hobli, Bengaluru North Taluk, cautioning the public not to enter the said property. They have also sought for a writ in the nature of mandamus to direct the respondent No.6 to remove the name of Government - 5 - HC-KAR NC: 2025:KHC:54049 WP No. 22657 of 2025 (Hullu Banni) in Sy.No.51 of Mallasandra Village, Yeshwanthpur Hobli, Bengaluru North Taluk. 2. It appears that the petitioners are the legal representatives of one Dalaiah, who purportedly was granted the land bearing Sy.No.51 of Mallasandra Village in terms of an order bearing No.42/5960 dated 31.10.1966. They claim that after such grant, the name of Dalaiah was entered in the revenue records. They contend that without proper notice to the petitioners, the revenue authorities have entered the name of the State Government in respect of 9 acres 24 guntas, indicating that it is a Hullu Banni and 2 acres in the name of the defence department. It is alleged that the name of Dalaiah was removed from the RTC in respect of Sy.No.51. (ii) The petitioners contend that the respondent No.5 claiming that the property belongs to it, has put up a board cautioning the public not to enter into the land. The petitioners are therefore before this Court challenging the action of the respondent No.5 and have sought for a direction to the respondent No.5 to remove the board and a direction to the respondent No.6 to delete the entries made in the name of the - 6 - HC-KAR NC: 2025:KHC:54049 WP No. 22657 of 2025 State Government in respect of Sy.No.51 of Mallasandra Village. (iii) The learned counsel for the petitioners submitted that the name of the predecessor of the petitioners appeared in the revenue records and therefore, without notice to the petitioners, no action could have been taken to change the revenue entries and the respondent No.5 could not have claimed that the property belongs to the Bruhat Bengaluru Mahanagara Palike. He therefore prays that the action of the respondent No.5 be interfered with and a suitable direction be issued to the respondent No.6 to delete the name of the State Government in the revenue records. 3. The learned Additional Advocate General on the other hand representing the respondent Nos.1 to 3 submits that the predecessor of the petitioners has purportedly sold the land to Sri.J.Doreswamy Reddy in the year 1967. He contends that the legal heirs of Sri.J.Doreswamy Reddy have filed W.P.No.48440/2016 for direction to enter their names in the revenue records. He therefore submits that the petitioners have no locus standi to question the acts of the respondent No.5 and - 7 - HC-KAR NC: 2025:KHC:54049 WP No. 22657 of 2025 no direction can be sought against the respondent No.6 to delete the name of the State Government from the revenue records. 4. I have considered the submissions of the learned counsel for the petitioners and the learned Additional Advocate General for the official respondents. 5. This Court, while disposing of W.P.No.48440/2016 has noticed that one Sri.J.Doreswamy Reddy had allegedly purchased the land in Sy.No.51 of Mallasandra Village from Dalaiah in terms of a sale deed dated 09.08.1967. It was also contended in the said writ petition that the name of Sri.Doreswamy Reddy was entered in the revenue records based on M.R.No.9/1978-79. This Court has also seen various revenue proceedings initiated by the legal heirs of Sri.J.Doreswamy Reddy. In W.P.No.48440/2016, the legal heirs of Sri.J.Doreswamy Reddy had sought for a direction to enter their names in the revenue records after the death of Sri.J.Doreswamy Reddy. It is therefore apparent that the petitioners have no subsisting right in respect of the land - 8 - HC-KAR NC: 2025:KHC:54049 WP No. 22657 of 2025 bearing Sy.No.51 in the face of the contentions raised win W.P.No.48440/2016. 6. In that view of the matter, the petitioners have no locus standi to seek for any reliefs against the respondent Nos.5 and 6. 7. In view of the above, the writ petition stands dismissed. 8.
