Panigrahi, ASC CORAM: JUSTICE V. NARASINGH ORDER 01.12.2025 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 1561 of 2024 pending on the file of learned S.D.J.M., Patnagarh, arising out of Belpada P.S. Case No. 368 of 2024 for commission of offences punishable under Sections 143/146/318(2) of BNS, 2023 read with Section 25 of Migrant Workmen (Regulation of Employment and Conditions of Service), Act, 1979. 3. The allegation against the present Petitioner is that without having a license under the Migrant Workmen (Regulation of Employment and Conditions of Service), Act, 1979 he was recruiting minor Order No. 1. labourers. 4. It is submitted by learned counsel that all the persons were going out of their own volition and the Petitioner has been falsely implicated. Hence, he may be protected by pre-arrest bail. 5. Learned counsel for the State opposes such prayer. 6. Taking into account the nature of allegations and the fact that all the workers who were being taken outside have been recovered and no harm has been caused to them, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification criminal antecedent of similar nature. 7. If it comes to fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to. 8. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 9. Accordingly, the ABLAPL stands disposed of. 10. U.C.C. as per rules. (V. NARASINGH) Judge BC Tudu
