Heard Mr. Redkar, learned counsel for the Petitioner. Also heard Ms. Kantharia, learned GP appearing for the Respondent. She has tendered reply on behalf of Respondent No. 3. The same is taken on record. 2. Mr. Redkar, the learned counsel for the Petitioner, submits that he does not want to file any rejoinder. As such, with the consent of both the sides, we proceed to dispose of the matter. 3. The controversy in this Writ Petition pertains to the demand for payment of dues on account of hire charges of vehicles delivered by the Petitioner to the Respondents during the election period. WP 782 OF 2021.DOC the department has released a sum of Rs. 7,88,638/- only by contending that the balance amount is not due and payable to the Petitioner. 4. By referring to the order dated 01.12.2022 earlier passed in this proceeding, the learned AGP Ms. Kantharia submits that this Court has already laid down that any disputed claim regarding the amount payable would have to be agitated before the Civil Court. We have perused the said order. After hearing the submissions at the Bar, we find that there is a serious dispute regarding the balance amount that is actually to be paid to the Petitioner. Therefore, in terms of the order dated 01.12.2022, the Petitioner will have to agitate the matter before the Civil Court. 5. As such, by granting liberty to the Petitioner to avail the appropriate remedy before the Civil Court, the Writ Petition stands disposed of. (S. M. MODAK, J.)
