SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court under Article 226 of the Constitution of India has been invoked by the petitioners seeking issuance of a writ in the nature of Mandamus, directing respondent Nos. 2 and 3 to ensure protection of their life and liberty. The petitioners, who claim to have solemnized marriage with each other against the wishes of the family members of petitioner No.1, have expressed apprehension of threat to their life and liberty at the hands of respondents No. 4 to 6. On perusal of the record, it appears that the petitioners submitted a representation to respondent No.2-Senior Superintendent of Police, Mansa, on
08.07.2025. However, without awaiting a response or action on the said representation, the petitioners approached this Court by filing the present writ petition on 09.07.2025. As per Notification No. HOME-HM-4040SECM/14/2025-2H4/63 dated 23.01.2025 issued by the Department of Home Affairs, Government of Punjab (Home-4 Branch), such representations are to be considered and decided SHAM SUNDER 2025.07.10 20:06 I attest to the accuracy and integrity of this document
CRWP-7334-2025 -2- by the Nodal Officer or other designated authority within a stipulated period of three days. In the present case, the petition has been filed prematurely, without allowing the competent authority the prescribed time to take action on the representation. This Court is of the opinion that the petitioners have approached the Court in haste, without affording an opportunity to the appropriate authority to redress their grievance. In view of the above, the present writ petition is dismissed as pre- mature, with liberty to the petitioners to approach this Court afresh, if the need so arises, after expiry of the stipulated period and in accordance with law.
