JUSTICE S.R.KRISHNA KUMAR ORAL JUDGMENT This appeal is filed by the defendant No.4 in FDP.No.7/2023 against the impugned order dated 03.02.2024 passed by the Principal Senior Civil Judge and JMFC, Bhadravati, whereby the report of the Court Commissioner was accepted by the trial Court which proceeded to direct drawing up of final decree by allotting properties in terms of the report of the Court commissioner. 2. Heard learned Senior Counsel for the appellant and learned counsel for the 1st respondent and perused the material on record. 3. Though the notice of this petition is served on respondents 2 and 3, they remained unrepresented and not contested the appeal. - 3 - HC-KAR NC: 2025:KHC:49763 RFA No. 713 of 2024 4. Though several contentions have been urged by both sides in support of their respective claims, having regard to the fact that the impugned final decree proceedings in FDP.No.7/2023 arise out of preliminary decree dated 04.03.2023 passed in O.S.No.37/2019 against which RFA.No.708/2024, which was preferred by the appellant herein culminated in a judgment and decree dated 01.12.2025 whereby this Court set aside the preliminary decree and remitted the matter back to the trial Court for reconsideration of the suit in O.S.No.37/2019 afresh in accordance with law, I deem it appropriate to set aside the impugned order and final decree passed in FDP No.7/2023 and remit the matter back to the trial Court for reconsideration of final decree proceedings afresh after disposal of O.S.No.37/2019 and in accordance with law. 5. In the result, I pass the following:- ORDER (i) Appeal is hereby allowed. (ii) The impugned order and final decree dated 03.02.2024 passed in FDP No.7/2023 by the trial court is hereby set aside. - 4 - HC-KAR NC: 2025:KHC:49763 RFA No. 713 of 2024 (iii) The matter is remitted back to the back to the trial Court for reconsideration of final decree proceedings in FDP No.7/2023 afresh after disposal of O.S.No.37/2019 and in accordance with law.
